The Affiliate agrees to indemnify and defend the Advertiser from and against any and all actions, demands, claims, proceedings, damages, losses, penalties, fines, costs and expenses arising out of or in connection with these terms.
You agree that any promotion or marketing of rentalcars.com, or the services, that you may undertake or conduct, shall comply with the following provisions:
Paid Search: In relation to any paid search advertising or any other form of online targeted advertising offered by Third Party Platforms ( means any third-party search engine, website, app, platform, tool or other device, meta-search engine, search engines spiders, travel search sites, price comparison sites, social networking communities, browsers, content sharing and hosting services and multimedia blogging services or other similar channels or other forms of traffic hosting media, whether online or offline.), you shall not (directly or indirectly) bid on, purchase, obtain, use or include in any text of any advertisement and/or in any ad copy, titles or descriptions or for use in text links, banner ads, pop-up ads or any other type of ad that could be associated with a keyword campaign, any term or keyword which is the same as or confusingly similar (including variations, misspellings and singular/plural forms) to:
(i) The term(s), including, but not limited to any of the TravelJigsaw Brands (means rentalcars.com, rentalcars, www.rentalcars.com, TravelJigsaw, carhire3000, rideways.com, rideways, Agoda.com, Booking.com, ActiveHotels.com, Priceline.com, Kayak, Villas.com, Open Table and any similar names, trade names and/or words), with whatever country code or top-level domain; or
(ii) Any trade marks and/or trade name (whether registered or unregistered) belonging to any of the car rental suppliers offered on any rentalcars.com website, including, without limitation, Hertz, Avis, Alamo, Europcar, Budget, National, Dollar, Sixt (“Third Party Brands”) and
(iii) Generic term(s) including but not limited to: car hire, cheap car rental, cheap car hire, car hire uk, car hire spain, car hire usa, car hire france, car hire Italy, car hire Ireland, car hire Belfast, and other similar references, unless agreed otherwise in writing by us.
Search Engine Optimization (“SEO”): You may not use any term which is the same as or confusingly similar to the TravelJigsaw Brands or the Third Party Brands, or use any trademark or trade name (whether registered or unregistered) belonging to or used or owned by any car rental supplier in any activity intended to unfairly influence the results of any Third Party Platforms unless agreed otherwise by us and shall comply immediately with any reasonable request from us to cease using any term in any paid search or SEO.
Save to the extent that it is an acceptable SEO practice or is within the Google webmaster guidelines (https://support.google.com/webmasters/answer/35769?hl=en), you shall not, either directly or indirectly:
(i) make our website and/or the services available on any Third Party Platforms; or
(ii) present any content appearing in relation to the services/on our website, or use techniques, to artificially influence search engine rankings or give the services/ website a higher ranking or display than it would otherwise have, or be displayed or ranked higher than it otherwise should be, if such actions or omissions (as appropriate) and/or techniques (including, but not limited to, using automatically generated content, participating in link schemes, cloaking, sneaky redirects, hidden text or links, doorway pages, scraped content and abusing rich text snippets) had not been used.”
Affiliates shall use reasonable endeavours not to advertise on sites that contain any material that may reasonably be considered obscene, offensive, defamatory or illegal.
No paid search using the brand name, wrong brand name spelling or competitor's brand name.
No use of brand name in header or ad text.
No use of brand name in the domain of any website.
No direct linking.
No automatic redirects from website to advertiser's website.
